Divorce Monday: A Toast To New Beginnings


The most difficult New Year’s resolutions to keep are the ones where you say, “I am going to do X every day” or, “I am never going to do X,” and the more abstract X is, the harder it is to keep your resolution.  The worst resolutions are, “I am never going to eat junk food” and “I am never going to get mad about unimportant stuff,” especially because the definitions of “junk food” and “unimportant stuff” are so poorly defined.  Is a peanut butter and jelly sandwich junk food?  Is a bank-breaking root canal unimportant?  More realistic goals are small and measurable, such as, “I will eat five servings of fruits and vegetables per day” or, “I will read all of Jane Austen’s novels this year.”  The easiest New Year’s resolutions are the “one and done” type of resolutions, where only a few minutes or a few hours of work at the beginning of the year reap rewards all year long, such as setting up a feature on your bank account where, every time you make a debit purchase, your account rounds it up to the next whole dollar and deposits the remaining cents into your savings account.  If your resolution is to get divorced in 2024, you are in for a year of exhausting work, but you can accomplish several of the big milestones quickly, such as filing your divorce petition or contacting a Birmingham divorce lawyer.

Why Divorce Monday?

Divorce Monday is the first business Monday of the year; in 2024, it is January 8.  Divorce lawyers have taken to calling the first business Monday in January Divorce Day, Divorce Monday, or American Divorce Day because it is one of the busiest days of the year for family law firms. On this day, courts receive more divorce petitions and divorce law firms receive more calls from new clients than on any other day of the year.  The reasons for this are several.  The most practical one is that, by filing for divorce at the very beginning of the year, you can make a clean break between tax years.  Other people start the divorce process at the beginning of the year in the spirit of making a new start.

Of course, getting divorced is not just like deleting an app or canceling your gym membership.  You cannot accomplish it in just a few clicks or just a few minutes of waiting on hold with customer service.  Unless you and your spouse have spent much of the old year discussing what you want the terms of your divorce to be, then your divorce will take at least a few months to finalize.  The best thing you can do now is to gather your financial records and to start putting your requests in writing regarding property division and parenting time.
